Terms of Use (General Terms and Conditions) and Licence Agreement for the App "RUDX"

By registering for or using RUDX, you accept these Terms of Use, the Community Guidelines and – for Premium – the Subscription Terms. The Privacy Policy explains how we handle your data.
1. What RUDX is
RUDX is an app for shared car tours: groups, tour planning, live map of the convoy, radio (push-to-talk), hazard and route notices, emergency features, recordings, community features and – in "RUDX Offroad" mode – aids for off-road driving. Some features are subject to a fee (Premium).
2. Minimum age and account
2.1 You must be at least 18 years old and legally capable of entering into this agreement.
2.2 Your information must be truthful. You are responsible for the security of your account. One account per person.
2.3 We may suspend or delete accounts that violate these Terms or the Community Guidelines (section 9).
3. Safety first – important notices
3.1 Traffic rules always take precedence. RUDX does not replace attentiveness, traffic signs, signals, police instructions or your own judgement.
3.2 No operation by the driver while driving, insofar as the law prohibits it. Use a fixed mount, use the push-to-talk button only where the law permits it, and let passengers operate the app whenever possible.
3.3 Speed: RUDX does not encourage fast driving. Top speed and performance data are private information. Performance measurements (e.g. 0–100 km/h, braking distances) and measurement mode are intended exclusively for race tracks or routes closed to traffic with the corresponding permission. This is prohibited on public roads.
3.4 Off-road and routes: Suggested or calculated routes – in particular tracks and dirt roads from open map data – may be prohibited for motor vehicles, private, closed, seasonally closed, damaged or dangerous. You yourself are responsible for checking passability, access rights, permits, weather and the capabilities of driver and vehicle. Vehicle limit values (e.g. maximum lean angle) are guidelines without warranty.
3.5 Not an emergency call centre: The emergency features of RUDX (SOS, call for help to the group, accident and rollover detection, emergency contacts, satellite instructions) are supplementary aids. They do not replace emergency calls (112, 911, etc.) and may fail – for example without network coverage, with a flat battery, with a locked or damaged device, with permissions switched off, if no other devices are within range, or because sensors fail to detect an accident or detect one incorrectly. In an emergency, always call the emergency number yourself.
3.6 Mesh without mobile network: The range depends on distance, terrain and number of devices. Messages may arrive late or not at all.
3.7 Weather, elevation, sunset, arrival times and GPS accuracy are estimates from third-party sources and sensors without warranty.
4. Right of use (licence)
4.1 We grant you a personal, non-exclusive, non-transferable, revocable right to use RUDX on Apple devices that you own or control, within the scope of the App Store usage rules.
4.2 Not permitted: copying, reverse engineering (unless mandatorily permitted by law), modifying or reselling the app, extracting data from it by automated means, circumventing security mechanisms or overloading the services.
4.3 All rights to RUDX (software, design, trademark, content provided by us) remain with Brevity or its licensors. Map data: © OpenStreetMap contributors (ODbL) and other sources named in the app.
5. Your content
5.1 You retain the rights to your content (photos, texts, voice messages, routes).
5.2 You grant us a worldwide, royalty-free, non-exclusive licence to store, reproduce, technically adapt and display your content to the persons you select – only insofar as this is necessary for the operation of RUDX. The licence ends when you delete the content or your account (except for copies held by others to whom you have already shown it, and backup copies until they expire).
5.3 If you share a route in "Discover", other users may use it for their own tours.
5.4 You warrant that you have the necessary rights (including to photos of other persons and vehicles) and do not infringe any third-party rights. Copyright complaints are governed by the document "Copyright & Reporting of Infringements".
6. Conduct and community
The Community Guidelines apply. RUDX tolerates no objectionable, offensive, hateful, sexual, violence-glorifying or illegal content and no abusive behaviour (zero tolerance). Content can be reported and users can be blocked. As a rule, we review reports within 24 hours and remove inadmissible content or suspend the responsible accounts.
7. Groups and organisers
7.1 Group admins and tour organisers set the rules of their group and decide on admissions. They act on their own responsibility, not on behalf of Brevity.
7.2 RUDX is a technical platform. The organiser of a drive or a track day remains the organiser or the group; permits, insurance, track rental and safety concepts are their responsibility.
7.3 Organisers may use participants' data (e.g. emergency contact) only within the scope of the tour and the Privacy Policy.
8. Premium, prices, payment
Paid features are sold via the Apple App Store. The Subscription Terms and Apple's terms also apply. Prices are displayed before purchase. Refunds are governed by Apple's rules and mandatory law.
9. Suspension and termination
9.1 You can delete your account in the app at any time. You cancel an ongoing subscription via Apple's subscription management.
9.2 We may suspend or delete accounts in the event of violations, abuse or endangerment of others, in serious cases with immediate effect. Where the law (e.g. the EU DSA) requires it, we give reasons for decisions and offer a means of complaint.
9.3 We may change or discontinue RUDX or individual features. If paid features are discontinued, we will inform you in good time; periods already paid for will be refunded pro rata to the extent provided by law.
10. Warranty
10.1 RUDX is provided "as is" and "as available". We strive for reliable operation but do not guarantee uninterrupted or error-free availability, any particular accuracy of positions, measurements, routes or forecasts, or the reachability of other users.
10.2 Mandatory statutory warranty rights (in particular for consumers in the EU/UK) remain unaffected.
11. Liability
11.1 We are liable without limitation for intent and gross negligence and – where mandatory – for damage resulting from injury to life, body or health and under product liability law.
11.2 Otherwise, our liability is excluded to the extent permitted by law, in particular for:
a) damage arising from participation in road traffic, drives, off-road drives, track days or measurement runs;
b) the non-functioning or malfunctioning of emergency, detection and mesh features;
c) content, conduct and information of other users, organisers and groups;
d) third-party routes, map data, weather and elevation data;
e) loss of data, insofar as it could have been avoided by customary backups;
f) indirect damage and loss of profit.
11.3 Insofar as an exclusion is not permissible, in the case of slight negligence we are only liable for foreseeable damage typical of the contract, up to a maximum of the amount you have paid us in the last 12 months, but at least CHF 100.
11.4 For consumers resident in the EU/UK, the mandatory liability rules applicable there apply (including liability for essential contractual obligations in the case of slight negligence).
12. Indemnification
You indemnify us against third-party claims arising from your content or from your unlawful use of RUDX, insofar as you are responsible for this.
13. Provisions for Apple (minimum App Store requirements)
13.1 This agreement is concluded solely between you and Brevity, not with Apple. Brevity – not Apple – is solely responsible for RUDX and its content.
13.2 The licence under section 4 is limited to use on Apple devices in accordance with the usage rules of the Apple Media Services Terms.
13.3 Brevity is solely responsible for maintenance and support; Apple has no obligation whatsoever to provide maintenance or support services.
13.4 If RUDX fails to conform to any applicable warranty, you may notify Apple; Apple will refund the purchase price, if applicable. To the extent permitted by law, Apple has no other warranty obligation; all other claims are directed against Brevity under this agreement.
13.5 Brevity – not Apple – is responsible for addressing any claims by you or third parties relating to RUDX, including product liability claims, claims that it fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
13.6 In the event of a third-party claim that RUDX infringes intellectual property rights, Brevity – not Apple – is responsible for the investigation, defence, settlement and discharge of that claim.
13.7 You confirm that you are not located in a country that is subject to a US embargo or that has been designated by the US government as a "terrorist supporting" country, and that you are not listed on any US government list of prohibited or restricted parties.

13.9 When using the app, you must comply with applicable third-party terms (e.g. those of your mobile network operator).
13.10 Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance, may enforce it against you.
14. Changes to these Terms
We may amend these Terms for objective reasons (e.g. new features, changes in the law). We will announce material changes in the app at least 30 days in advance. If you do not object or continue to use RUDX thereafter, the new Terms apply; we will point this out to you in the announcement. If you object, you can delete your account or cancel your subscription at the end of its term.
15. Applicable law and place of jurisdiction
15.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules.
15.2 The place of jurisdiction is Stans, Canton of Nidwalden, Switzerland.
15.3 Consumers retain the protection of the mandatory provisions of their country of residence and may also bring proceedings at their place of residence, or may only be sued there, to the extent provided by law (e.g. EU, UK, Québec).
16. Final provisions
Should any provision be invalid, the remainder shall remain valid. The German version is authoritative, unless mandatory law provides otherwise (in Québec, the French version).
